Bantu Dereva Driver Terms & Conditions

This is a legal agreement between you (“Driver”) and Mswahili (T) Company Limited
(trading as Bantu). By registering, logging into, or using the Bantu Dereva App,
you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Definitions
- “Platform” means the Bantu Dereva App, websites, and related services.
- “Driver” means an individual registered to receive ride or delivery requests.
- “User” means a passenger or delivery recipient using the rider app.
- “Trip” means a ride or delivery from pickup to drop-off.
- “Service Fee” means the commission charged by Bantu per Trip.
- “LATRA Rules” means the Land Transport Regulatory Authority Act and Private Hire
Regulations.
2. Independent Contractor
You operate as an independent contractor. You are not an employee, agent, partner,
or joint venture of Bantu. You control how, when, and where you provide services,
subject to these Terms and applicable laws.
Bantu does not provide insurance by default. Any insurance programs are governed by
separate terms.
3. LATRA Compliance &
Licences
3.1 Driver Registration
- Hold a valid Tanzanian driver’s licence for commercial public service driving.
- Maintain all licences, endorsements, medical certificates, and required documents.
- Register with LATRA’s licensing system where required.
3.2 Vehicle Compliance
- Be licensed by LATRA for private hire or ride-hailing use.
- Meet LATRA standards on age, condition, and safety.
- Display any LATRA-issued stickers or markings.
- Maintain valid commercial insurance.
- Pass inspections as required by law.
Failure to maintain compliance may result in immediate suspension or permanent
deactivation.
4. Driver Account & Security
- You are responsible for all activity under your account.
- Keep your login credentials confidential.
- Report unauthorised access immediately.
- Bantu may suspend or terminate accounts for violations or safety concerns.
5. Ride Acceptance &
Completion
- You may accept or decline Trip requests.
- Accepted Trips must be completed responsibly and promptly.
- Repeated cancellations or manipulation may lead to deactivation.
6. LATRA Fare Structure & Service
Fees
6.1 Approved Fares
- Operate only within LATRA-approved fare structures.
- No unapproved surcharges outside official guidelines.
6.2 Service Fee
- Bantu retains a Service Fee within LATRA-permitted limits.
- Fees may change but will not exceed regulatory caps.
7. Payments & Taxes
- Earnings are paid after Service Fee deductions.
- You are responsible for all applicable taxes and levies.
- Bantu does not withhold taxes on your behalf.
8. Ratings & Performance
User ratings and feedback may affect account status, including retraining or
deactivation.
9. Professional Conduct
- Comply with all traffic and LATRA regulations.
- Provide respectful, non-discriminatory service.
- No harassment, violence, threats, or misconduct.
10. Safety, Accidents &
Incidents
- Report accidents or incidents immediately via the App.
- Cooperate with authorities and investigations.
11. Device, Data & Tracking
GPS must remain enabled while online. You consent to collection and use of data
for safety, compliance, and operational purposes in line with the Privacy Policy.
12. Intellectual Property
All Platform content and software remain the property of Bantu.
13. Deactivation & Sanctions
Bantu may suspend or deactivate accounts for violations, safety risks,
or invalid documentation.
14. Limitation of Warranties
The Platform is provided “as is” without guarantees of earnings or availability.
15. Limitation of Liability
Bantu is not liable for accidents, losses, or indirect damages. Liability, if any,
is capped at fees paid in the previous three months.
16. Indemnity
You agree to indemnify Bantu against claims arising from your conduct or violations.
17. Governing Law
These Terms are governed by the laws of the United Republic of Tanzania.
18. Updates to Terms
Continued use of the Platform after updates constitutes acceptance.
